Terms of Service

1. Acceptance of Terms

By accessing or using the EarthVue platform (“Service”), operated by EarthVue Pty Ltd (ABN pending) (“we”, “us”, “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

EarthVue is a spatial operations platform that enables users to upload geospatial boundaries, run remote sensing analysis, generate reports, manage field operations, and share results. The Service includes web applications, APIs, and supporting infrastructure.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorised use.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Upload malicious files, viruses, or harmful content
  • Attempt to gain unauthorised access to the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Resell or redistribute Service access without written consent

5. User Data & Intellectual Property

You retain ownership of all data you upload to EarthVue (“User Data”). By uploading, you grant us a limited licence to process, store, and display your data solely to provide the Service. We do not claim ownership of your spatial data, analysis results, or generated reports.

The Service, its source code, design, and documentation are protected by copyright and intellectual property laws. You may not copy, modify, or distribute any part of the Service.

6. Subscriptions & Credits

Paid plans are billed monthly or annually. Analysis credits are allocated per billing cycle and may accumulate. Credits are non-refundable and non-transferable. We reserve the right to modify pricing with 30 days’ notice. Downgrades take effect at the next billing cycle.

7. Data Processing & AI Features

The Service uses remote sensing algorithms and AI models to generate analysis outputs, metrics, and narrative reports. AI-generated content is provided as-is and may contain inaccuracies. You are responsible for verifying outputs before relying on them for regulatory, legal, or operational decisions.

8. Third-Party Data Sources

The Service integrates data from third-party providers including Copernicus (Sentinel-2), Geoscience Australia, and other government and commercial sources. These data sources are subject to their own licensing terms. We do not guarantee the availability, accuracy, or continuity of third-party data.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide reasonable notice of planned downtime.

10. Limitation of Liability

To the maximum extent permitted by law, EarthVue and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless EarthVue from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time. Upon termination, your data will be retained for 30 days before permanent deletion, unless required by law.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.

14. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance.
